Soil

Soil quality is an important factor for the transaction, development, exploiting and finance of property.
We advise manufacturing businesses with regards to contaminated land issues (Dutch Contaminated Land Guideline, Soil Risk Checklist, Action Plan Soil Quality Protection Measures).

 

 

We assess the contamimated land situation for companies that let or lease premises at the start and termination of the Environmental License of Lease Agreement. (Ground Ivestigation at start and end, as per Dutch Standard NEN5740). We offer security to financiers and investors in property with regards to the soil quality in relation to the future use. We sometimes undertake this work based on available information (Quickscan Historical Ground Investigation as per Dutch Standard NEN5740).

In most cases remedial action is not required if soil contamination has been established at a site and the site use is unlikely to change in the future. Redevelopment of a site with contaminated land issues may be the reason for soil remediation. We prepare, manage and report remediation projects for building companies, developers and architects. During the preparation we provide the required investigation (Detailed Investigation as per Dutch Standard NTA 5755). In consultation with the client and the Local Authority we work out the best possible Remediation Action Plan and apply for all required permits. If desired we manage the tender process and contract agreement with the contractor. During the remedial works we project manage the remedial works and take care of the Environmental Guidence (Hofstede cs Milieuadviseurs is an official ‘intermediair’ by the Ministry of Infrastructure and Environment). At the end we issue all lawfully required documents to the Local Authority.  

As a result of our extensive experience we are often commissioned by our clients to assess work undertaken by third parties (second opinion), which we deliver gladly, honourable, transparent and well founded. In some events the essence of a case has a legal character. We then cooperate closely with the client’s legal advisor or with a specialised solicitor’s office.
